Chapter 1. General Provisions

Article 1 (Purpose)

This agreement aims to stipulate all matters and requirements related to membership conditions and the use of web services (hereinafter referred to as the "service") provided by the Korea Language Education Center (hereinafter referred to as the "education center"), Sogang University.

Article 2 (Effect, Application, and Changes in the Agreement)

  1. (1) This agreement shall take effect for all users, as it is publicly announced on the service screen. All members who consent to this agreement and sign up to become members shall be subject to the terms and conditions of the agreement as soon as they have consented. When there is a change in the agreement, members shall be subject to the changed agreement as soon as such changes take effect.
  2. (2) When a rational reason is provided, the education center may change the agreement. When it changes the agreement, it shall specify and announce the date of application and the main reasons for revision without delay.
  3. (3) When they do not agree to changes to the agreement, members may make a request for membership cancellation. A member is seen to agree to a change in the agreement once they have continuously used services without showing any intention of refusing the change 7 days after the effective date of the changed agreement (the last day shall be extended to the next business day if it falls on a Saturday or holiday).

Article 3 (Regulations not Specified in the Agreement)

  1. (1) This agreement shall take effect with the guide to the use of individual services posted within the service.
  2. (2) Matters not clarified in this agreement and the guide to the use of individual services posted within the service shall be subject to relevant laws and the purpose of service-specific instructions.

Article 4 (Term Definitions)

  1. (1) The definitions of terms used in this agreement are as follows:
    1. ① A 'user' is a member or non-member who accesses the service and receives services provided by the education center according to this agreement.
    2. ② A 'member' is one who can continuously receive information regarding the education center and keep using its services after completing the membership application and registration process.
    3. ③ A 'non-member' is one who uses the service provided by the education center without becoming a member.
    4. ④ An 'ID' is a combination of letters and numbers selected by a member and then approved by the education center for member identification and the use of services.
    5. ⑤ The 'password' is a combination of letters and numbers selected by a member to protect his or her information and ensure safe service usage.
    6. ⑥ A 'user agreement' is a contract on the use of services concluded between the education center and a user.
    7. ⑦ 'Termination' is the action taken when the education center or a user ends a service user agreement.
    8. ⑧ An 'operator' is a person selected by the education center for the overall management and operation of the service.
  2. (2) The terms used in this agreement shall be defined according to relevant laws or service-specific guidance except those specified in the above section.

Chapter 2. Service User Agreement

Article 5 (Application for the Use of Services)

  1. (1) A user who intends to use the service shall provide all information (name, date of birth, email address, phone number, address, etc.) requested by the education center to become a member.
  2. (1) A member shall certainly provide his or her own name and date of birth to use the service. He or she shall register his or her English name as it appears in his or her passport to exercise all rights.
  3. (3) When a member steals another person's name and personal information to apply for the use of services, the relevant member's ID shall be deleted and he or she may be punished in accordance with relevant laws and regulations.
  4. (4) The education center may classify members using the service and subdivide service hours, the number of services provided, the service menu, and other options for differentiated use of services.

Article 6 (Application Acceptance)

The education center shall approve the use of services in the order of receipt when there is neither a work-performance problem nor technical difficulties. However, it may cancel or refuse an approval for the use of services when one of those described in the following clauses occurs:

  1. (1) When a member makes an application in breach of the matters specified in Section 1 to 3 of Article 5;
  2. (2) When a member provides false information in an application form;
  3. (3) When a member makes an application to disturb social stability, order, and traditional customs;
  4. (4) When a member intends to use this service for illegal purposes or in pursuit of profits:
  5. (5) When a user in competition with this service makes an application;
  6. (6) When it is judged that the education center has limited facilities or is experiencing technical difficulties;
  7. (7) When a member makes an application in breach of other specified matters.

Article 7 (Conclusion of the User Agreement)

  1. (1) The user agreement shall be concluded after a user agrees on the content of the agreement and applies for the use of services and the education center approves the user's application.
  2. (2) A user shall express his or her intentions to proceed by pushing a button marked "Agree" when applying for the use of services.

Article 8 (Assignment, Change, and Other information on User IDs)

  1. (1) It is principle to issue only one user ID per person under the real name written on their resident registration card.
  2. (2) It is essentially impossible to change the user ID. When a member intends to change his or her ID, that member shall terminate the relevant ID and then reapply for the service.
  3. (3) A user shall take responsibility for his or her user ID and password. A user shall take responsibility for damages in the use of services or third-party abuse caused by negligent management. The education center shall not take any responsibility for such occurrences.
  4. (4) A user ID shall neither be shared nor transferred.
  5. (5) A user ID may be changed at the request of a relevant user or the education center when one of the situations described in the following clauses occurs:
    1. ① When an invasion of privacy may be feared because a user ID is registered as a telephone number or resident registration number;
    2. ② When a user ID is repellent to other people or is against traditional customs;
    3. ③ When there are other rational reasons.
  6. (6) A user ID may be interlocked with a member ID in another service of the education center, and used by a relevant member, with his or her consent.
  7. (7) When it is difficult to provide services because there are duplicate user IDs, the education center may request the relevant user to change his or her user ID to an ID which does not overlap with any other IDs. Moreover, it may change the ID in a way in which the essential part of the ID remains unchanged, in accordance with a justifiable reason such as site integration and important policy changes. In this case, the education center shall notify the relevant member of the change.

Chapter 3. (Obligations of the Contracting Parties)

Article 9 (Obligations of the Education Center)

  1. (1) The education center shall have a member use a desired service on the service commencement date chosen by that member, allowing that there are no special circumstances.
  2. (2) When facility failure or damage occurs, the education center shall repair or restore service to provide reliable service without delay, barring some unavoidable reason.
  3. (3) It shall build a security system and publicly announce and follow its personal information protection policy in order to protect personal information.
  4. (4) It shall neither leak members’ personal information to the outside nor distribute/provide information to a third party without prior consent from the user. However, it is considered an exceptional case when the release is recognized as necessary at the request of a national agency, through appropriate legal procedures, for the purpose of investigation, or for the public good. A member's personal information shall be protected according to relevant laws and the personal information protection policy specified by the education center.
  5. (5) The education center shall immediately handle members' opinions or complaints through proper procedures when they are objectively recognized to be right. However, it shall notify relevant members of the reason and processing schedule when it is difficult to handle an issue immediately.

Article 10 (Member Obligations)

  1. (1) A member shall write all matters based on fact under his or her real name when he or she applies for membership or changes his or her information. He or she shall not be able to claim any rights when registering false or third-party information.
  2. (2) A member shall follow the matters prescribed in this agreement, all regulations decided on, and notices formally announced by the education center and relevant laws. He or she shall not commit any act which disturbs the business of the education center or brings disgrace on the education center.
  3. (3) When there is a change in the content of the user agreement such as address, phone number, and email address, a member shall immediately notify the education center of such a change through relevant procedures
  4. (4) A member shall neither use, reproduce, publish, nor broadcast information obtained while using services for commercial purposes. In addition, he or she shall not provide information to a third party. The education center shall not take responsibility for the results of such acts. When such an act causes damage to the education center, the member shall have the obligation of compensating the education center for damages. The education center may limit the use of services or claim damages against a relevant member through legal procedures.
  5. (5) A member shall neither transfer nor give his/her right of service use and status, as specified in the user agreement, without the explicit consent of the education center. Moreover, he or she shall not provide these as a matter of security.
  6. (6) A member shall manage his or her information for the use of services. When there is a change in the registration matters specified in Article 5, Section 1, he or she shall immediately publish the change through the personal information correction page within the service.
  7. (7) A member shall not commit any of the acts specified in the following clauses: When a member performs one of these acts, the education center may limit the use of services or impose sanctions including legal measures.
    1. ① An act of registering false content when he or she applies for membership or changes his or her information;
    2. ② An act of using another person's ID and password illegally;
    3. ③ An act of trading his or her user ID with others;
    4. ④ An act of changing the client program of the education center, hacking its server, and arbitrarily changing some or all of the services or information posted, without any special right given by the education center;
    5. ⑤ An act of infringing on the rights and intellectual property rights of the education center or a third party;
    6. ⑥ An act of causing damage to the service, disturbing it deliberately, and registering data infected with a computer virus;
    7. ⑦ An act of sending, posting, and spreading information, sentences, figures, sound, images, or other forms of content going against public order and traditional customs to other people via email or other methods;
    8. ⑧ An act of bringing disgrace to or giving a disadvantage to other people;
    9. ⑨ An act of collecting or retaining other users' personal information without the approval of the education center;
    10. ⑩ An act judged to be related to a criminal act;
    11. ⑪ An act of impersonating a manager, employee, or the person interested;
    12. ⑫ An act of violating the regulations, terms, and conditions of use specified by the education center including this agreement;
    13. ⑬ An act of going against other relevant laws.

Chapter 4. Use of Services

Article 11 (Service Hours)

  1. (1) It is a principle that the service is available 24 hours a day, 7 days a week, and 365 days a year. However, some or all services may be interrupted when one of the specific reasons listed in the following clauses occurs: In this case, the education center shall give notice in advance or at a later date.
    1. ① When there is a reason such as maintenance, expansion, replacement, and breakdown of the system;
    2. ② When the service cannot normally be provided due to a state of national emergency, power outage, service equipment failure, and excessive login attempts.
  2. (2) Any advanced notice shall not be possible when the service is interrupted due to a reason which cannot be controlled by the education center (disk failure, system outage, and other circumstances arising independent of a system operator's intentions or negligence). There will be no notice when the system is shut down due to the intentions or negligence of a third party (PC Communication Education Center, a key telecommunication service provider, and others).
  3. (3) It may split the service into a specific range and separately designate available service hours according to range. In this case, it shall give notice of the content.

Article 12 ( Service Change and Interruption)

  1. (1) The education center may notify a member of the content and provision dates of a service to be changed in order to change and provide the service.
  2. (2) It may limit or interrupt some or all of the services when one of the following specific reasons applies:
    1. ① When there is a reason such as maintenance, expansion, replacement, and breakdown of the system;
    2. ② When service interruption is inevitable due to a reason which cannot be controlled by the education center;
    3. ③ When the service cannot normally be provided due to excessive login attempts;
    4. ④ When the education center judges that it is necessary to replace the existing service with a new service;
    5. ⑤ When there is an uncontrollable reason such as a power outage, natural disaster, or state of national emergency.
  3. (3) It may limit the provision of certain services for a member not using his or her real name, under the age of 14, protected according to the 'Youth Protection Act,' or under the age of 20, as well as foreign or corporate members.
  4. (4) It shall notify members of service interruptions caused by a reason specified in Section 2 in advance. However, when it is deemed impossible to give any advanced notice due to service interruptions caused by a reason which cannot be controlled by the education center (for example, a disk failure not caused by a system operator's intentions or negligence).

Article 13 (Termination of the User Agreement)

  1. (1) When a member intends to terminate a service user agreement, that member shall personally make the request for member withdrawal.
  2. (2) A member is regarded as a new member when he or she signs up for a membership again after terminating a user agreement.
  3. (3) When a member commits a prohibited act, as listed by law or in this agreement, or commits an act judged to be destructive to traditional customs, the education center may limit the relevant member's rights of service usage for a certain period of time or disqualify him or her entirely from using the service. However, the education center shall give prior notice to the relevant member before disqualifying him or her from using the service. Moreover, it shall give the member an opportunity to correct or vindicate himself or herself.

Article 14 (Service Provision and Notices to Members)

  1. (1) The education center may provide members with a variety of types of information and advertisements, recognized to be necessary for the use of services in many ways such as by email, mail, and through wired/wireless media. It may provide members with information about specific topics at a cost through a separate application.
  2. (2) A member may use the advertising content delivered through the service or participate in advertisers' promotional activities according to the advertising contract between the education center and advertisers. If there is a dispute between a member and an advertiser in this process, the education center shall make an effort to complete the following activities, as specified in the clauses below:
    1. ① The education center shall provide a member with necessary information (identifying the winner from those participating in advertisers' promotional activities) to protect the member's rights and prevent damages.
    2. ② If an advertiser is objectively proven to have damaged a member (or members) deliberately through the press, it shall request him or her to discontinue their advertising currently available on the service or take proper measures (setting a limit on the conclusion of the advertising contract for the same content with the relevant advertiser)
  3. (3) It may notify a member in many different ways: send emails to the email address registered to his or her account; make a phone call to the registered phone number; and use other means of communication, as provided by the education center within other services. However, when it gives notice to members having trouble getting bulk mail and many unspecified members, the education center may replace an individual notice with a notice posted on a service board.
  4. (4) A member may not receive an important notice from the company when that member provides false personal information or neglects the obligation of changing items specified in Article 10, Section 6.

Article 15 (Copyright on Posting Materials)

  1. (1) The copyrights for materials posted or registered by a user on the service shall belong to the relevant user. On the other hand, the copyrights for works written by the education center and other intellectual property rights shall be vested in the education center.
  2. (2) A user shall allow the education center to use his or her posts at home and abroad for the purposes specified in the following clauses:
    1. ① To reproduce, correct, renovate, exhibit, send, and distribute the user's posts, and make edited works within the service;
    2. ② To exhibit and distribute the user's posts within the service managed by the education center;
    3. ③ To report and telecast the contents of the user's posts to the media, news agencies, and others to promote the service of the education center.
      However, the education center shall not provide personal information for the media, news agencies, and others without the member's individual consent.
  3. (3) In spite of the contents specified in Sections 1 and 2, the education center shall get the relevant user's consent in advance to use his or her posts for commercial purposes in addition to the purposes specified on the previous section. The education center's request for the use of posts, the user's consent, and withdrawal of consent shall be made in the way requested by the education center such as by phone, email, and fax.
  4. (4) When a member withdraws his or her membership account or loses their membership, the posts recorded in his or her account(s) shall be deleted. However, it is principle not to delete posts necessary for other users' normal use of services such as posts republished by a third party through clipping and copying.
  5. (5) The education center may change the published locations of posts due to a merger and business transfer of the education center or the integration of websites managed by the education center, while not changing the original content of the posts.

Chapter 5. (Compensation for Damages and Other Matters)

Article 16 (Compensation for Damages)

The education center shall not take responsibility for any damages in relation to matters unrelated to what is specified in the personal information protection policy in the case of the use of free services.

Article 17 (Exemption Provisions)

  1. (1) The education center shall be exempted from responsibility for service provisions when it cannot provide services due to a natural disaster, war, or equivalent uncontrollable forces.
  2. (2) It shall not take responsibility for damages caused by telecommunication services disconnected or abnormally provided by a key telecommunication service provider.
  3. (3) It shall be exempted from liability for damages caused by an unavoidable reason such as the repair, replacement, regular maintenance, and other hindrances to service facilities.
  4. (4) The education center shall not take responsibility for any obstacle or damage to the use of services caused by a reason attributable to a member.
  5. (5) It shall not assume responsibility for damages caused by a user's computer error or false personal information and email address provided by a member.
  6. (6) It shall not be responsible for any loss when a member does not make or lose any profits expected from the use of services.
  7. (7) It shall not bear responsibility for damages caused by data obtained while using services. Moreover, it shall not have any responsibility to compensate for damages caused by other members' errors or mistakes while using services.
  8. (8) It shall not take responsibility for the reliability, accuracy, etc., of information and data posted by a member on the service.
  9. (9) It shall have no obligation to intervene in a dispute between users or a user and a third party through a medium of the service. In addition, it shall not take any responsibility for resultant damages.

Article 18 (Jurisdiction and Governing Law)

  1. (1) When legal action is taken to solve a dispute between a member and the education center, which occurs while the service is provided and used, a competent court shall be employed as the court wherein the premise of the head office of the education center is located.
  2. (2) Korean law shall apply to the lawsuit between the education center and user.

[Additional Provisions]

(Date of enforcement) This agreement shall enter into force from July 25, 2014.
